China issued the Regulations on the Protection of Computer software on June 4, 1991, and the Regulations came into force on October 1, 1991. The Regulations stipulated that any software released after the promulgation of the Regulations may be registered with software registration authorities and be granted a certificate and published. The certificate is a preliminary proof for the validity of the copyright.
Thereafter, the Rules on the Registration of Computer Software was issued, which gave detailed implementing procedures for software registration. Under the Rules, an applicant for the registration of software should furnish the following documents:
A) Applications forms
B) Introduction to the software
C) Identity document of applicant. In case of a natural person, this refers to identity card; Business license in case of a legal person. Notarization and legalization is needed;
D) Programming source material. Sixty pages of software source program covering beginning, middle and finishing parts;
E) Design description, user manual, operation guide
F) Power of attorney.
Two copies are required for each of the above. The State Copyright Bureau, responsible for software registration, shall finish examination within 120 days from formal accepting the application, and in case that the requirements are met, an application for registration should be approved. Certificate will be issued and the registration be published.
